Most divorcing spouses are able to agree to joint legal custody of their children, which means that regardless of where the children live, both parents will have an equal voice in the major decisions that affect the child's education, health care, religious training, and other essential aspects of a parent's responsibility. In most cases, one parent will have primary physical custody by having the children live in the parent's residence. The other parent will normally have overnight visits with the children under a visitation or parenting plan.
